Problem
To halt the spread of the Delta variant of Covid, the federal government sets up travel checkpoints at bus stations, airports, and where the interstate highways cross State lines. People who can show proof of full vaccination are allowed to continue their journey. People who cannot show proof must take a Covid test or turn around. The government sets up more checkpoints in Black and Brown communities than White communities. Therefore, White individuals often can travel uninterrupted, while racial minorities experience significant delays in their travels. Black travelers file a lawsuit claiming an equal protection violation. What level of scrutiny should the court apply? Why?
