An employee was returning from military leave, and his documentation was a little fishy in the eyes of the employer. Clearly something was off, but the court held that a strict reading of the Uniformed Services Employment and Reemployment Rights Act (USERRA) was required; and given that strict reading the employee had certain rights that his employer violated - even though the employer may have good grounds to doubt things. After reading this case, do you think the court made the right decision with their strict adherence to the USERRA statute? Or should they have allowed for an employer to make reasonable judgments when having an employee return from leave?
