Lindenwood Properties owns several apartment complexes in the St. Louis metropolitan area. Martha rented a basement unit in one of Lindenwood's buildings. Martha's lease with Lindenwood Properties contained a provision that Lindenwood was not responsible for and had not liability for any personal injury or property damage resulting from mold. A few months after moving into her apartment, Martha began to have trouble breathing. Martha continued to have respiratory problems, and later was diagnosed with a fungal infection in her lungs due to exposure to mold.
