Tom decided to buy his girlfriend, Geri, the latest Orange Series 9 smartwatch for her Christmas present. The watch cost $800. The watch was described to come with sapphire crystal glass that is known to be very durable and resistant to scratches. Geri was extremely excited to receive the watch.
Tom and Geri went cycling on 26 December 2022. Unfortunately, they had a minor accident. Geri fell from the bicycle and her Orange Series 9 smartwatch knocked against the floor and became badly scratched. They took the watch back to the retailer, but the retailer refused to provide an exchange on the ground that Geri had scratched the watch carelessly.
Tom and Geri are very upset, and they have come to you for your advice.
Required:
(a) Explain the sources of law in Singapore.
(b) Tom and Geri would like to settle their dispute with the retailer quickly and as cheaply as possible. Advise Tom and Geri on the most appropriate court or tribunal to start their legal action at.
(c) Explain the term "alternative dispute resolution" (ADR), the different types of ADR available and advise Tom and Geri whether ADR might be a viable option for them.
