Problem
Annie and Ethan are retirees living at Beverly Hill Apartments along Caine Road. Annie's apartment (Flat 9B) is on the ninth floor, while Ethan's apartment is directly above Annie's apartment on the tenth floor (Flat 10B). Ethan, who is romantically involved with Annie, decides to hire a contractor to renovate the kitchens in both their apartments in time for the Chinese New Year. Ethan contracts with Naomi to "refurbish the kitchens in Flat 9B and Flat 10B, Beverly Hill Apartments by or before 25 January with redwood laminate carpentry and dragon-themed metal fittings (drawer handles, doorknobs etc.)". In the written contract between Ethan and Naomi, Ethan does not disclose that one of the apartments belongs to Annie and makes an advance payment of 50% of the contract price to Naomi. Ethan then takes Annie on a holiday for two weeks and returns, on 26 January, to find that while Naomi had renovated the kitchen in Flat 10B according to specification, Naomi did not have enough of the correct building materials and refurbished the kitchen in Flat 9B with silver-coloured panels and beetle shaped fittings instead. Ethan and Annie are horrified by the negative implications of Naomi's renovation works on the fengshui in Annie's kitchen.
