This is for real estate- if earnest money is not delivered on time by the designated broker who would be informed first? The client or the title company?

When a person is helping a firm get a client (who has a license) and the firm said they would pay them a little commission when do they get payed? After closing, during closing, before closing or after closing and not on the agreement at all.

When would a attorney be able to do real estate activities without having a real estate license? Would it be when they don't get a commission when they do or not at all they can't.
