Problem
Most rape shield laws prevent certain aspects of a victim's sexual history to remain outside of the discoverable evidence the defendant is entitled to have access to in a criminal case involving rape. What if evidence of the victim's sexual history would prove that the defendant was not guilty? Does this mean that an otherwise innocent person will go to jail and be required to register as a sex offender for a crime they did not commit?
