Problem
Divorce is expensive! Not only does the couple have to divide assets while doubling living costs, they are also going to incur legal costs and fees. Many couples try to save money on legal expenses. While an attorney cannot represent both sides of a divorce in most states, an attorney can represent one individual in the couple and the other person can remain pro se (representing him/herself). Recall our discussion of ethics, specifically the concept of conflicts of interest. What ethical issues do you predict could arise in such a situation? What societal problems could arise? What should the legal profession do to mitigate these negative consequences?
