Justice McLachlin of the Supreme Court of Canada in Winko v. British Columbia stated that "the goals of the Mental Disorder Framework are the protection of the public and treating mentally disordered persons justly and appropriately."
1. What conflicts and or issues do you see in striking a balance between the safety of the public and the liberty rights of an accused person who has been found NCR?
2. Answer the question by making a distinction between the forensic and civil mental health systems; define and explain NCR within the context of the question above. For example, when is it applied or occurs, and are there any conditions/requirements to which it's associated?
