The Delta City Police Department has recently begun to utilize the SnortScope 500. This is a hand-held device roughly the size of a police car radar unit that can detect cocaine in the air at a distance of up to 200 feet. Detectives Pettigrew and Morris are sitting in their unmarked police car across the street from Sam Raybum's house. They point the SnortScope at Rayburn's house,
and the SnortScope detects the presence of cocaine inside the house. Using this information, the detectives procure a search warrant. They serve the warrant on Rayburn, search his house, and find a large quantity of cocaine in a dresser drawer in Raybum's bedroom. Raybum is arrested and charged with possession of cocaine and trafficking in cocaine (because of the large quantity of the drug found).
Using Kyllo v. United States as a guide, prepare a one- to two-page paper that discusses whether the cocaine evidence should be suppressed as the result of an unreasonable search. Include a final determination as to whether the cocaine should, in fact, be suppressed.
