Assignment:

Read the case of Siegenthaler v. Johnson Welded Products, Inc., after reading the case, prepare a two-page paper addressing the following questions:

1. Suppose Spires was sent by Johnson Welded Products to do a welding job in Montana. Spires was provided a Johnson Welded Products truck and stayed at a motel rented by Johnson Welded Products. Could the court have ruled differently? What facts would have changed the court's decision?

2. Suppose instead that Spires was driving a Johnson Welded Products truck when he struck Siegenthalers motorcycle. Suppose also that Spires had stopped for lunch alone at a diner on Highway 30 halfway between the customer he just left and the next customer he was doing a welding job for. Could the court have ruled differently? What facts would have changed the court's decision?

3. Suppose, in the above scenario, all facts remain the same except that Spires hit Siegenthaler's motorcycle because Siegenthaler cut Spires off in traffic ("road rage). Would this additional fact change your answer to Question 2? If so, what would your new answer be?

Answer these questions thoroughly, incorporating your knowledge of agency law and liability.
