This question has two parts (part A and part B) and both parts must be answered.
Part A: The fundamental objective of the Land Registration Act is that "under the system of electronic dealing with land that it seeks to create, the register should be a complete and accurate reflection of the state of the title of the land at any given time, so that it is possible to investigate title to land on line, with the absolute minimum of additional enquiries and inspections." Critically discuss the above statement with reference to relevant case law and academic discussion. (2000 words)
Part B: Frank, an artist, viewed and later purchased, The Works, a small semi derelict engineering factory. His intention was to convert it into a Studio for his own use. Whilst viewing the property he noticed a number of items that he thought to be of value and that he believed to form part of the property of ‘The Works'. These items were: a) An antique light fitting that hung from a cast iron bracket. The bracket was secured to an external wall of the factory by a dozen metal screws. b) A large pile of rusting lengths of steel that had been left lying in a storeroom. c) An old but substantial timber outbuilding that stood on stone pillars but was otherwise unattached to the land. d) A furnace constructed of stone, steel and cast iron, which was held to the ground by its own weight. When Frank took possession of the building he discovered that all of these items had been removed from `The Works` by the seller. Advise Frank of any claim he may have to these items, supporting your advice by reference to relevant legislation and case authority. (1000 words)
