The Mitchells bought a tract of land from Brannen. They subsequently transferred it back to Brannen by a deed that was never delivered to Brannen. Brannen then conveyed the property by a deed that was delivered to Hardeman and then recorded. Mitchell sued Hardeman to determine who owned the property, claiming that the property was his. Is Mitchell correct? (Hardeman v. Mitchell, Tex. 444 S.W.2d 651)
