The FLSA makes various exemptions from overtime pay. In other words, some positions within an organization do not qualify for overtime pay based on the nature of the job. They are: (1) executive employees; (2) administrative employees; and (3) professional employees. Jobs in these categories are exempt from overtime pay.

Despite the guidance from FLSA in defining these terms, it is sometimes difficult for employers to determine if a particular job fits within any of the exemptions. .
