Problem:
Notice that, in Section 7 of the Agreement, the Agency gives assurance to the Company that it is currently complying with all laws and that it promises to continue to comply with the law in the future. If the Agency wants a similar assurance and promise from the Company and would want to sue the Company if the Company is not currently complying or fails to comply with all laws in the future, which contract concept(s) [representation and warranty; covenant; condition; discretionary authority; declaration] should each of the assurance that it is complying and promise that it will comply be reflected as in the Agreement?
