Problem related to the law of limitation


Problem: ANZ Limited (a commercial bank operating its business in Bangladesh) for promotion of its business, offered a 'loan scheme' under which any customer may obtain House Building Loan in 7 days' time; provided he (client) enter into a contract with them (Bank) with stipulation/provision -"that the period of limitation as contain under the Law of Limitation would not be a bar for the Bank to sue the clients in case of default in payment of loan". Mr. Hafiz, a client of the Bank, obtained a loan under the aforesaid 'loan scheme'. Afterwards, he could not pay the money back in time. The Bank sued Mr. Hafiz for breach of contract but failed to file the suit within the limitation period. The lawyer of Mr. Hafiz argued in the court that the said suit of the Bank is barred by limitation and as such, the Bank has no remedy in law. On the other hand, the Bank pleads that the contract under which the above loan was sanction enables them to sue even when the period of limitation is over. -Discuss.
