Mary bought the moped to use as transportation to and from school. A week after Mary bought the moped, she was rushing to school on the moped when she came to an intersection as the light turned yellow. Because she was late and the intersection had a three-way light, she decided to go through the yellow light and gunned the motor to build speed. Suddenly, she realized that she could not get through the intersection before the crossing traffic. She applied her brakes quickly but they failed to respond. She lost control of the vehicle, which jumped the curb onto the sidewalk and struck David, who was waiting on the sidewalk for the signal for pedestrians to cross the street. Mary and David were injured in the accident. If Mary Asserts a claim against Motorcycle Shop based on strict liability in tort, will she prevail?
