The right to a fair trial includes for serious offenses the right to a trial by a jury of one's peers. This right has been operationalized by defining such a jury as embodying a "fair cross-section of the community" so that representative groups are neither over-included nor under-represented in the jury pool. Still, there have been studies that suggest that may state court juries are, in one way or another, not fairly representative of the communities in which the court hearing the case sits.
