Your client is the operator of a large U.S. jazz festival in Washington. The festival is expanding its offerings and wants to include international music this year. The festival organizers are able to book a well-known group of Cuban musicians.
Tickets have been sold out in advance for this festival worth hundreds of thousands of dollars. In the months prior to the event, relations heat up between Cuba and the U.S. As a result of this conflict the U.S. decides it will no longer participate in cultural or educational exchange as it has been doing. The musicians from Cuba however are already en route to the U.S. when this decision is made. They are denied entry at Miami Airport.
Your firm has been hired by the jazz festival organizers to assist them in resolving this situation. Your attorney plans to prepare a motion for a temporary injunction preventing the U.S. government from denying access to the Cuban musicians. In an internal memo to your attorney, provide support for the temporary injunction by researching and advising in regard to the following questions:
What powers under U.S.law, if any, give the U.S. the ability to take this action?
What harm will the jazz festival experience if the Cubans are denied entry into the U.S.?
What remedies under U.S. law does the jazz festival have, and against whom? Research and cite similar cases.
