Jurisdiction - Court of Appeal
However S.64 (1) of the Constitution gives that the Court of Appeal 'shall have such jurisdiction and the powers in relative to appeals from the High Court as may be conferred on it through law'.
Therefore the Appellate Jurisdiction Act 1977, S.3(1) gives that 'the Court of Appeal shall have jurisdiction to hear and conclude Apelles from the High Court in cases whether there an appeal lies to the Court of Appeal under any law'. In fact Section 3(3) of the Act further gives that in the hearing of an appeal in exercise of the jurisdiction conferred through the Act that then the law to be applied shall be the law applicable to the case even as it was being heard in the High Court.
