Is the argument of cynthia counsel correct

Problem: Cynthia and Diana were members of the LGBT community. They lived together for 10 years without any problem. They even took care of Diana's nephew Jay who they treated as their child. Diana was the bread winner while Cynthia stayed at home and took care of Jay. They were also able to buy a condo unit, a house and lot and two cars. However, these were registered to them only as co-owners. Sadly, Diana died of stroke and with no Will. The brothers of Diana came with their lawyers claiming that the properties bought by their sister should belong to them. Cynthia was helpless as she knows she did not contribute a single centavo to the properties that Diana bought. Worst, Jay was taken to her by her true biological parents. Cynthia found a lawyer who argued that all properties she and Diana acquired should be presumed to have been acquired by their joint industry and owned by them in equal shares. Is the argument of Cynthia's counsel correct? Explain.
