Instructions to the candidates;
Take the scenario shown below and write the trail of correspondence leading to the point of implementation of a compensation event. Assume that the first notification is sent the day that the protesters enter the site – August 2014. Make other assumptions that you have to; be inventive, but stay within the realms of possibility and write in a simple straightforward style, using clause numbers where necessary, to demonstrate the management of this problem through the standard conditions. The contract you are working on is the Engineering and Construction Contract (ECC) – Main Option C
Scenario:
On a major highway scheme, a group of environmentalists get onto the site and start to dig tunnels under the new road formation. It takes the police 3 weeks to negotiate with the protesters and clear the site. However, 1 week after the protesters enter the site the key piece of equipment that the contractor ordered from Germany fails to arrive as required by the Accepted Programme so the contractor would not have been able to work in this period in any case.
The letters should be structured to acceptable industry standard; including headings, endnote references and page numbers.
