Does everyone understand the difference between criminal prosecution and civil remedies? Think OJ Simpson--acquitted in a criminal court and found liable in a civil case. What about Martha Stewart, Kobe Bryant, etc.? Should an individual (because of high price attorneys, political or social or economic position, etc.) be in a position to LEGALLY escape criminal prosecution? Should a person be able to "buy off" the victim by settling a potential civil action, thereby securing the victim's silence and refusal to testify in a criminal action?
