Problem

The Federal Trade Commission (FTC) is the agency who is responsible for addressing false claims or false advertising of a product that does not produce the results it is advertised to produce.

One example in your textbook discusses a settlement with the marketers of a pain relief device named Quell. The settlement involved the marketers agreeing to pay at least $4 million dollars and an agreement to cease making the device. The deceptive claims included statements that the device treats pain throughout the body when place below the knee and is clinically proven and cleared by the Food and Drug Administration (FDA) to do so. (FTC, 2020, March 4, as cited in Payne, 2022, p. 275).

The order that settled the FTC's allegations included that the marketers of Quell must stop making claims unless they are true, not misleading, and supported by competent and reliable scientific evidence. The order further prohibits misrepresentations about clinical proof or the cope of FDA clearance for any device and required the marketers to pay redress.
