On May 15, 1988, Cowboy Bob (a former rodeo clown) and his brother, Cowboy Carl (also a former rodeo clown) started the Clowning Around Dude Ranch ("Clowning Around"). Clowning Around provided a fun and easy outdoor experience for people who never had the opportunity live the outdoor life (e.g., ride horses, catch fish and sleep outdoors). After decades of success, Bob and Carl decided it was time to retire. Good Times (a nationwide chain of dude ranches) made a very generous offer to purchase Clowning Around. After prolonged negotiations, Bob and Carl signed a contract with Mr. Shorty (president of Goods Times) for the purchase and sale of Clowning Around. Shortly after the sale is completed, a dispute arises about whether or not the following items are included in the sale. The contract is silent concerning these items:

• Two large clown statues (each weighing 150 pounds). The statues sat on a concrete pad at the front entrance to Clowning Around and are held in place by eight concrete screws;

• A picture of Bob shaking hands with then president Ronald Reagan. The picture hangs in Bob's office and is held in place by four screws and a safety strap;

• A built in (i.e., underground) sprinkling system, used to water the ranch's many grassy areas; and

• A Cold Shed used for storing a broad selection of adult beverages. The shed sits on a concrete pad and is held in place by eight safety hooks (two on each side). The hooks can be easily released so that the shed can be moved from one part of the ranch to the next. For the last 20 years, the shed was often placed on top of Bob's pickup and driven throughout the park.
