Daniels sells Formula One memorabilia. He sold an autographed Michael Schumacher helmet to Wehry for $3, 500. While in Daniels shop, he saw a reproduction of an Aryton Senna helmet which he also wanted. He was told it was only sold in a set of three, but that Daniels would see if the distributor would sell it individually. A few days later he told Wehry he would sell it separately. Wehry told him to order it. When it arrived, Wehry also wanted a Ferrari model and told Daniels he would pick it and the helmet up when the Ferrari model arrived. When it arrived, Wehry said he would be in the following week to pick both up. When he didn't come, he told Daniels that he had been busy and would pick them up before Christmas. This didn't happen, and Daniels finally sued. Wehry admitted he had ordered the items. Can Daniels collect even though there is no writing? Why?
