You are counsel to KableCom, a cable company that provides home broadband internet service. KableCom is interested in switching from an unlimited data service to a data-use pricing model. Customers would have the option to prepay for an initial data allocation at a fixed rate with additional fees for data overages, or simply pay for the actual amount of data used during a billing cycle. While connections to websites will not be slowed, sped up, or blocked in any way, KableCom wants to introduce the “Unlimited Stream Plan.” Under the Unlimited Stream Plan, customers will be able to choose three streaming cloud apps from a short list of approved sites that have paid KableCom for the opportunity to participate. Customers will be permitted unlimited streaming on the three sites they select without accruing data charges.

Please prepare an internal memorandum for KableCom in which you assess the chances that the Unlimited Stream Plan could be successfully implemented in the current regulatory climate.
