Create a legal liability for the agency

Assignment:

David Kacsur

In this scenario, Darla takes notice that several of Mike's assigned clients are seeking counseling with her and making comments that suggest a possible experience of unethical behavior. While this situation definitely raises concerns, Darla should avoid making assumptions and follow the appropriate ethical procedures to address this issue. The ACA Code of Ethics provides guidance for situations involving potential ethical violations by colleagues. Standard I.2.a clearly states: "When counselors have reason to believe that another counselor is violating or has violated an ethical standard and substantial harm has not occurred, they attempt first to resolve the issue informally with the other counselor if feasible, provided such action does not violate confidentiality rights that may be involved" (American Counseling Association [ACA], 2014, Standard I.2.a). If and when appropriate, Darla could attempt to discuss this situation with Mike to clarify what may be happening. However, in this situation, because they are both practicum students working under direct supervision, it may be more appropriate for Darla to consult their shared supervisor and share her personal observations without disclosing unnecessary client details. The ACA Code of Ethics also addresses situations when concerns are not resolved informally. Standard I.2.b states: "If an apparent violation has substantially harmed or is likely to substantially harm a person or organization and is not appropriate for an informal resolution or is not resolved properly, counselors take further action appropriate to the situation" (ACA, 2014, Standard I.2.b). If Darla informs the supervisor and no action is taken, she may need to consult her faculty supervisor or training program for other guidance. Ignoring the (potential) unethical conduct could also place clients at risk and in-turn create a legal liability for the agency. Taking appropriate steps ensures that client welfare and professional standards remain the sole priority. Need Assignment Help?
