Clyde worked in the Information Management department at a huge investment bank. The bank managed funds for large institutions and also helped companies raise capital, in other financial endeavors and merge. Clyde was bored, so over a few months he prepared software that would extract .1% from each account at the bank and place it in his checking account.

Over the course of 2 years, he stole $132,000 from the bank. He used the money to open a bar. The bar was a suitable way for Clyde to hide the funds that he stole, as he would ring up fictitious sales and put the cash into the register.

Rarely, Clyde would also come across significant information about client companies, such as production techniques and customer lists. Occasionally, he could sell this information to competitors of the company. He earned $65,000 over the course of two years from such sales and mailed the proceeds to an account he set up in Montana.

While Clyde was on vacation, the auditors discovered Clyde's misdeeds. Upon his return, Clyde's boss confronted him with the evidence. Clyde grabbed a paperweight from his table, threw it at his boss, killing him. Clyde then jumped out of his window and ran. He saw an unlocked car, jumped in, hot-wired it and drove off. He drove to a gas station, clutches his tire jack, walked into the store, and held the jack up to the clerk's head, demanding a carton of Marlboros and that the clerk turn on the gas meter. Clyde then filled up and drove off. Clyde was apprehended a few miles down the road.

a. Determine and discuss under what circumstances could the bank's top managers be liable for Clyde's taking the money from the bank?

b. Check five crimes that Clyde committed. For each crime:

i. List the elements of the crime

ii. Explain the sentences associated with the crime

iii. Show the conduct that fits the crime. For example, write Murder- Clyde threw the paperweight at his boss, killing him.

iv. Use the same set of facts for only 1 crime and choose the highest crime. for example, throwing the paperweight would also be battery or attempted murder, but you will only use one crime for a set of facts you would want the highest crime, which would be murder
