Problem
Jack and Jill want up a hill to fetch a pail of water. However, the well was on the land of Old McDonald and he did not give Jack or Jill permission to take the water. He warned them on numerous occasions to stop taking his water and buckets to store the water in. Jack and Jill ignored him. Finally, Old McDonald called the police and Detective Olivia Benson arrived on the scene and arrested both Jack and Jill immediately.
Detective Benson separated the two and spoke to Jill. Benson told Jill was that Jill should confess and her charges may be reduced. Benson did not say anything else to Jill. Jill sang like a bird and told Benson that she and Jack have been stealing pails and water every day and were selling the "special" water and pails on eBay. Jill also said that they made over $2,000,000 this year from doing this. During Jill's trial, Assistant District Attorney, Jack McCoy, attempted to introduce these statements into evidence. Can Mr. McCoy do this? Explain why?
