Problem

John is trying to get on train and the train is just leaving the station. He is carrying a brown bag full of fireworks. The conductor on the car opens the door for John, and tries to help him onto the train car, while John is running after the train car to catch up. While he is running, John drops the bag of fireworks onto the track. The fireworks explode with some significant forces. Libby, who is standing on the platform, is knocked down by the force of the explosion, and breaks her arm. Analyze the following questions:

a) Assume John is harmed. Does he have a claim against the railroad?
b) Does Libby had a claim against (i) John, and/or (ii) the railroad?
