Problem: Toronto manufacturer of lighting equipment in a contract with an Africa Buyer. FCA Port of Toronto Incoterms 2020. Seller agrees to deliver the goods to container terminal in Toronto. Goods transported to container terminal (seller's truck) and offloaded by a reach stacker. During offloading the reach stacker drops the goods and the goods are destroyed. Buyer argues that since the Bill of Lading had not been provided to the buyer, the tile to the goods still resided with the seller (i.e. the seller still owns the goods and therefore is the party has suffered a loss).
