Sun N. Snow is a professional skier who lives in Florida. He entered into a sponsorship agreement with Skis-R-Us (SRU), a Washington partnership. Among other things, the agreement provided that SRU would provide health insurance for Sun. Sponsorship negotiations were carried out mostly over the phone. SRU drew up the agreement in Washington and sent it to Sun in Florida, via mail; Sun signed and returned the agreement to SRU via mail as well. Sun went to Colorado to participate in an Alpine Ski Race. While skiing, his took a hard fall and broke both of his legs. Recovery involved months of physical therapy. The costs of medical care for Sun exceeded more than $100,000 including the surgery and related medical expenses. Since SRU had not obtained health-insurance coverage for Sun, Sun seeks to sue SRU for breach of the agreement.
