Ross needed a grinding mill and consulted Clifton, who on occasion repaired such mills but did not sell them. Ross and Clifton together selected a mill from a catalog, which Clifton happened to have on hand, that they decided would meet Ross's purposes. Ross instructed Clifton to order the mill they had selected, and Clifton did so in his own name and with his own money.

When the mill arrived, Ross refused to accept it, stating that it was too small and would not do the job he intended it to do. Clifton brought suit to recover the amount he had spent. The judgment was for whom and why?
