Saskatchewan Government Insurance v Medynski (Lakeland Towing), 2012 SKQB 157 (CanLII) SGI would tender an offer to tow truck operators by publishing the rates it would pay. Tow truck operators would provide services and be entitled to payment pursuant to the published rates. Medynski complained that SGI's rates were too low and advised SGI that he would charge rates that were reasonable and which may be greater than the published SGI rates. Medynski provided towing services and charged a rate higher than SGI's rates. SGI paid the higher amount under protest, and then sued to recover that "excess and unreasonable fees." What type of contract existed prior to Medynski's complaints about the SGI rates? Was there a contract in place after he complained? If not, cHow much would he be paid?
