What is the importance of legal profession to our democracy

Discussion Post: School Contamination

The beauty of the law is that it provides new and ever more current examples of issues that we are discussing. Consider the following:

A school was built 50 years ago on a toxic site. The decision makers knew of the toxic site since it had been in operation for 100 years applying solvents and oils to the ground which has a high water table, thereby dispersing the chemicals. Which of the following individuals or groups has the best standing to sue?

• A teacher who worked at the school for 30 years who developed breast cancer. Her grandmother died of breast cancer. There are no other cancer indicators in her medical history.

• Parents of a third grade boy at the school who discovered a benign lump on the boy's genitalia during his annual physical. The parents are concerned that the boy may never be able to have children of his own at adulthood.

• A parent network who have all had children at the school who believe their children are all at risk at some time in the future for cancer because of the toxics.

• A group of twelve teachers who have all developed a unique strain of kidney disfunction leading to a high risk of cancer. Two of the twelve have cancer indicators in their family. None of the twelve have any history of kidney disease.
