Problem
Anne recently participated in a five a-side soccer competition organized by her local soccer club in Tung Chung. On entry to the sports ground where the games were played there was a large sign that stated `Enter and play at your own risk. The Tung Chung Ladies Soccer Club shall not be responsible for any injuries for whatever reason(s)'.
During a game Anne was tackled from behind by Margaret and fell heavily to the ground. Unfortunately for her there were some small holes on that uneven part of the field on which she had landed heavily causing her to break her right ankle as a result. It was later discovered that the reason why these holes were on the field was the improper maintenance by the soccer club due principally to the financial problems that it had encountered due to substantial losses of revenue from the pandemic.
Her friend Elizabeth offered to drive Anne to the nearest hospital for treatment. Anne got into the front seat of the car but despite being told twice by Elizabeth she did not wear the seatbelt as she was in pain due to the broken ankle. When Elizabeth approached an intersection near the hospital her car was rammed into by Kingsley who had driven his car at above the speed limit through a red light. Anne suffered head injuries as a result of the accident and the attending doctor at the hospital told her said that her injury would have been significantly less serious had she worn her seatbelt.
Having recovered from her injuries Anne now seeks your advice as to the possible legal actions that can be taken against the Tung Chung Ladies Soccer CIub, Margaret, Elizabeth and Kingsley. What is the advice to Anne?
