You can use existing e-mail in your inbox or send e-mail among each other; however, what is most important is discussing all relevant / pertinent items found in the full e-mail header. Approach it from a forensic perspective such as proving or disproving email came from a particular sender.

Question 2. Presentation of Evidence.

Being an expert witness is a difficult. To be candid, testifying isn't for everyone. Even if you are technically proficient, if you cannot speak with confidence and convince the jury that you are correct, you will fail in your task as an expert. I've met many great forensic examiners, but very few would do well in a courtroom.

What is the primary role for an expert witness when they testify? What are the characteristics you would want to see in a testifying expert witness? While you might want to look for expert witness testimony to support your point(s) and be competent, think of the other characteristics of a good, testifying expert witness. (I'm not talking about Federal Rule of Evidence 702. I'm talking about the traits a person must have when they testify.)
