Discuss Griswold. What are the differing doctrinal commitments as to how the Fourteenth Amendment (and the Ninth Amendment) should be approached in the opinions? What philosophical theories do you think shed light on these doctrinal commitments? You may need to discuss both history and prior case law, but do so sparingly, only as much as is necessary to make clear what the issues are.
