The way we deal with juveniles provides a blueprint for some issues raised in this chapter. The law has always treated juveniles differently going back to England and the common law. Here in America the original premise was to rehabilitate.

Then there was an attempt to exempt certain crimes from the rehab concept and punish them as adults.

I had a client that fell into this area. I represented the youngest juvenile to be certified for capital murder in Texas.

He was 50 days past his 14th birthday at the time the crime was committed. He and 3 other individuals attempted a carjacking and a pregnant lady was shot and died. Under Texas law he was sentenced to life with parole after serving 40 years flat time.
