Was the theatre within its legal rights in choosing not to

When the Strand Theatre of Shreveport Corporation's collective bargaining agreement with its union expired, the theatre refused to bargain with the union over a new contract.

Under basic contract law, when a contract expires, the parties are free to make or not make a new contract; a new contract is not made unless there is assent to all terms by both parties.

Was the theatre within its legal rights in choosing not to bargain with the union after the expiration of the collective bargaining agreement? Decide. [NLRB v. Strand Theatre of Shreveport Corp., 493 F.3d 515 (5th Cir. 2007)]
