However common law may be illustrated as that branch of the law of England that was developed through the English courts on the basis of the ancient customs of the English people. Since Osborn's law dictionary explains the common law as "that branch of the law of England formulated administered and developed through the old common law courts on the basis of the common custom of the country".
Mostly it is not the entire common law that is a source of England law although only which portion that the Judicature Act illustrate as "the substance of the common law". thus this presumably connote that the writ system and its complex rules of procedure which were developed by the old common law courts for the administration of the common law do not apply to England.
