Think about the various NSA surveillance tactics as they are revealed by Edward Snowden. Do you think that the government has a right to access your telephone records, emails, and web history in the name of "national security"? The Court's interpretation of Smith v. Maryland (at least in the case of phone records) indicates that in these situations, a claim to the Fourth Amendment right to privacy cannot be applied.
