There are several alternative approaches that society can take to deal with the problem of iatrogenic injuries, namely; professional standards; government regulation; medical malpractice laws based on negligence and no fault laws that provide compensation to persons injured during medical care but no proof of negligence is required. Consider the following examples and explain how each of the four approaches would be best for (1) providing incentives for safety in future medical care or (2) the replacement of losses of injured person, recognizing that an approach may or may not satisfy both (1) and (2). A surgeon performs an operation while intoxicated. Consider each of the following alternative outcomes. The patient has some minor problems but does not realize that they are related to surgical errors The patient has to be readmitted for surgery to correct errors in the original surgery The patient dies because of errors in the original surgery.
