The sellers of a house knew that it was termite-infested. Prior to sale, they whitewashed the basement and attached strips of wood to certain areas of the joists to cover up the more obvious damage. Other areas were obscured by shelves on which jars and clothing rested. The sellers had treated the property for termites, but had not corrected the structural damage. Buyers inquired about the construction and were told that the joists were “sound and as good as new.” After purchasing the house, the buyers discovered the damage. Were they the victims of fraud? If so, what kind of fraud is this?(i.e. fraud in the inducement or fraud in fact?) What remedies are available to them? Explain.
