Summer flew her airplane to the Shelby, NC airport where she rented a tie-down space at the airport and appropriately secured her airplane with the tie-down ropes provided. She kept the keys to her airplane with her. She informed airport personnel someone, besides her, may come by and take the airplane on a flight.
In the next couple of days, airport personnel discovered a thunderstorm with strong winds heading towards the airport. Airport personnel checked the tie-downs on Summer’s airplane and found them to be secure. There was also no available hanger space to move the airplane inside.
After the storm had passed, airport personnel checked Summer’s airplane and found there to be extensive damage due to the high winds. Sometime later, Summer came in to find her airplane to be damaged and unable to be flown. Summer filed a lawsuit against the airport to recover damages to the airplane. She claimed there was a bailment relationship with her and the airport when she parked her airplane.
