Problem
In a breach of contract case, the plaintiff brings up witness 1 who is asked what the defendant said about the contract she made with the plaintiff. The defense attorney objects and says that witness 1 is about to offer hearsay testimony! The judge calls up the attorneys for a bench conference to discuss the objection. The plaintiff's attorney says that witness 1 is going to tell the jury that the defendant told him that she was going to rip off the plaintiff. The defense attorney says it's inadmissible hearsay! You be the judge and make the ruling. Should you allow witness 1 to testify to what the defendant said? Why or why not?
