Should the judicial branch have the ability to develop and implement public policy, or should that power belong exclusively to the executive and legislative branches? One of our assumptions throughout the course and in the assigned text is that judges routinely engage in policymaking but what would judicial policy look like if they were not completely divorced from the context of public policy?
