So the rule regarding with delivery are like;

(a)  The goods should be in a deliverable state and one is

(k) The goods delivered are mixed about goods of a different description, such the buyer is entitled to like;

  1. Reject the goods and one is
  2. Accept those included in such contract and reject the balance also.

(l) Therefore unless otherwise agreed the buyer is such not bond to accept delivery through instalments there

(m)  Conversely delivery is through instalments to be paid for separately and the seller makes one or more defective deliveries or such the buyer neglects or refuses to admit and pay one or more deliveries  this is treated as a severable breach or may like a total repudiation of the contract depends on like;

  2. Whether the circumstances of the case also.

(n)   Whether the buyer refuses to take delivery like of right he would not be bound for return the goods although must notify the seller his refusal.
