Robert mendoza declared that he bought a winning lottery


Robert Mendoza declared that he bought a winning lottery ticket and was entitled to collect the 5.5 million dollar prize.  He had lost the ticket and was unable to claim the prize because lottery rules prohibited awarding the prize without the ticket.  Mendoza sued the lottery commission because printed on the back of all lottery tickets were the words "This ticket is a bearer instrument so treat it as if it were cash."  Mendoza argued that he could collect on the ticket if he met the requirements pertaining to lost bearer instruments such as proof of ownership and the terms of the instrument.  Other evidence indicated that Mendoza had purchased the winning ticket.  How should the court rule?  Discuss fully.
